While doing some of my normal scanning of the Plain Dealer today I came across this story! Then I read the comments left by people about the story and it made me sick! It's people like them who make it so rape victims never come forward and forever live their lives hiding this painful event in their past. I am sure some girls do make stuff up and I'm sure not all guys are guilty but to assume it was some sort of relationship gone bad or anything like that is ridiculous. How many people did they discourage from coming forward about being raped. People ignorance and prejudging nature drive me insane! This poor girl living six years with this horrible secret decided to come forward for no other reason then to protect her sister. People have a tendency to do for others what they should do for themselves. I'm betting the idea of her younger sister being in contact or near the man that has caused her six years of distress and pain was more then she could handle so she came forward to protect someone she loves. However ignorant people decided to not reward her strength but instead put her down or accuse her of lying. I applaud this girl for coming forward in doing so she did not just protect her sister from this man but any woman or young girl he comes in contact with.
Lakewood schoolteacher arraigned on rape charge

LAKEWOOD — Brian Biermann, 35, of Rocky River, was arraigned today on rape, kidnapping and sexual battery charges.
He pleaded not guilty and his bail was set at $25,000.
Biermann, on paid leave from his teaching job at Lakewood High School, is accused of raping a 15-year-old student in his classroom in January 2004.
The former student, now 21, recently went to police.

Not saying he didn't do it, but why wouldn't she go to the police when it did happen instead of 6 years later? I am thinking maybe it was a relationship that went sour.

It sounds a little like BS - I mean if I were raped I would report it and granted she may have a little sister going there, but who knows if she would have him as a teacher? I agree with the above poster that it was a relationship gone sour.
I mean he was a fool for getting involved with a student - but these girls need to wake up - why fall for your teacher???????? That is just wrong. And grant it the teachers are in power and should walk away from this type of temptation. So for r that he deserves to be punished, but rape I don't think so.

I am assuming that you're talking about a current relationship and not a relationship at 15 because a 15 year old does not have relationships with her adult teachers.
If what you believe jdcw is true then he was CRIMINAL for getting involved with a student.

There should be a shorter statue of limitations on rape cases. If you dont come forward, oh well, your loss. I am sick of hearing of people coming forward after 5+ years. It is way too late by then, no evidence, no case, bottom line why wait 6 years? Unless you have a personal agenda or maybe she is just a liar. Either way if he is found not guilty she should have to do the time he would have been sentenced. I find it really really really really hard to believe that a girl would let something like rape go for 6 years.If it did happen and she is telling the truth, she still is an idioit and thats the bottom line.

im sorry pack..i WOULD know what to do! I would have went straight to the principals office!!! Wonder why no one heard her crying or yelling...IF she was making any noise at all...it MIGHT be a relationship gone sour...yeah ive had cute teachers in my day but didn't want any of them! These grown Men and women need to be locked up preying on young children!

If she is worried about her sister...what a bunch of crappolla...If she didn't like what was happening to her...she wouldn't have gone back for seconds...thirds...fourth....she needs to be penalized for not saying anything from the beginning...i say ...she wasn't a victim...but...the teacher might have dumped her and she feels this is the way to get even...it's too late WOMAN...it should have been said when she was a GIRL....

I find the long wait pretty strange too. 5 years ??? to come forward. But, who really knows the whole story but her and the accused! I sure can't speculate on the unknown.

Now I understand why girls/women don't report rapes. Because they are not taken seriously and because they are so traumatized that they simply can't. Perhaps some of you would understand rape better if you read the statistics on it and how difficult it is to get a victim to report it let alone get the rapist convicted. This cannot be easy for this young woman and none of us know what it took to report this crime. I think bail should be set much higher so that the community is aware that this is a crime that is taken seriously. Hopefully, compassion will be shown for the victim.

I can very easily see a young woman waiting years to bring this up. There are many girls out there that don't have the self esteem to stand up for themselves. They are subject to all kinds of physical and emotional abuse and they internalize the damage and withdraw. If for some reason this woman received counseling and her self esteem rose she may very well come forward. Or her fear for her sister could have set it off. Either way I can see it taking years to come up.
However, I don't know the facts just like the other posters don't know the facts. Either of these folks could be lying or the truth could be somewhere in the middle. But please don't discount her words just because it has been 5 years.

What is really awful is that all of are assuming that he is guilty. What most people don't realize is that when you are a guy, all it takes is an allegation to get you lableled and outkasted from your job, family, and anything else you belong to. It doesn't matter if you did it or not, everyone is going to remember you becasue of what you were accused of.
Now...if he had any type of sexual involvement with this girl he should go to jail. He may have done it to multiple students and she's the only one to have come forward. It is going to be really hard to prove 5 years ater the fact though.
